La Corte declaró la responsabilidad internacional del Estado de Ecuador por la violación a los derechos a la libertad de expresión, el principio de legalidad, la circulación y residencia, la estabilidad laboral, las garantías judiciales y la protección judicial, y el deber de adoptar disposiciones de derecho interno, en perjuicio de los directivos del medio de comunicación impresa de Guayaquil. “El Estado realizó un reconocimiento parcial de responsabilidad internacional en este caso”, dijo el organismo. La Corte IDH dispuso una serie de medidas de reparación integral a su favor. Entre ellas, dejar sin efecto, en todos sus extremos, la sentencia de 20 de julio de 2011, confirmada el 22 de septiembre de 2011; establecer vías alternativas al proceso penal para la protección al honor de los funcionarios públicos respecto de opiniones relacionadas con su actuación en la esfera pública. globalfreeThis case is currently before the Inter-American Court of Human Rights which issues its admissibility report on October 27, 2015. The President of Ecuador filed a defamation complaint against journalist Emilio Palacio, the newspaper “El Universo” and its executives for publishing an article he believed violated his right to honor and to his good name. The Ecuador National Court of Justice upheld the criminal and civil ruling which awarded 40 million dollars in collective damages and sentenced the newspaper’s executives and the journalist Emilio Palacio to three years in prison. They have appealed to the IACtHR arguing that the criminal offense of defamation against public officials goes against the right to freedom of expression provided for in international treaties signed by Ecuador, and therefore, this offense should be repealed because it contravenes a “supra-constitutional” norm.globalfreedJournalist Emilio Palacio published an article in the newspaper “El Universo” titled “No to lies” (“NO a las mentiras”), regarding actions by the President of Ecuador during events of national importance. The President considered that the article violated his right to honor and to his good name, and therefore filed a complaint against the article’s author for the crime of defamation (injuria calumniosa, or falsely accusing someone of a crime).
